By creating an account or using Simple Business Website, you agree to these Terms and Conditions.

1. About Simple Business Website

Simple Business Website is an online service that allows businesses to create and manage their own business websites.

The service is intended for business customers only. By using the service, you confirm that you are at least 18 years old and that you are authorized to represent the business you register.

2. Account registration

To use the service, you must create an account.

You are responsible for keeping your login details safe and for all activity that happens under your account. If you believe that someone else has access to your account, please contact us as soon as possible.

3. Free plan and paid plans

Simple Business Website may offer a free plan and paid subscription plans.

Paid subscriptions may be available on a monthly or yearly basis. The available features, prices, and limits may depend on the selected plan.

We may change our prices, plans, features, or the service at any time. If a change affects your paid subscription, we will try to inform you in a reasonable way.

4. Domains and subdomains

Customers may receive a free subdomain as part of the service.

If a customer wants to connect an official/custom domain, this requires an upgrade to the PRO plan.

Customers are responsible for buying, owning, renewing, and managing their own domains through a third-party domain provider.

5. Payments

Payments may be processed through third-party payment providers, including Stripe and PayPal.

By choosing a paid plan, you authorize the payment provider to charge the applicable subscription fees. Subscriptions renew automatically unless cancelled.

Invoices are sent by email.

6. Cancellation

You may cancel your subscription at any time.

After cancellation, your PRO features will normally remain active until the end of the already-paid billing period.

If a payment fails, is disputed, charged back, or reversed, PRO features may be disabled immediately.

7. Refunds

Refunds are available only for the first payment and only if requested within 14 days of that first payment.

After this period, payments are non-refundable, unless we decide otherwise at our own discretion.

8. Customer content

You are fully responsible for all content you add, upload, publish, or display on your website. This includes, but is not limited to: text, images, logos, business information, links, products, services, offers, legal notices, and required website information.

All content you upload or create remains yours. You confirm that you have the rights and permissions needed to use any content you publish through the service.

9. Customer responsibility for legal pages and compliance

You are responsible for making sure that your website complies with all laws and regulations that apply to your business and your customers. This may include, where relevant, your own Impressum, Privacy Policy, Cookie Policy, terms, cancellation policy, business details, tax details, and any other legal notices required for your website.

TopSoft UG is not responsible for the legal correctness or completeness of your website content or legal pages.

10. Prohibited use

You must not use the service in a way that harms, disrupts, abuses, or risks the security of the platform, our systems, or other users. This includes, but is not limited to:

  • Trying to hack, bypass, or break the service
  • Uploading malware or harmful code
  • Overloading or attacking the platform
  • Scraping or copying the service in an automated way
  • Trying to access other users' accounts or data
  • Using the service for illegal activity
  • Misusing payment systems, refunds, or disputes

11. Suspension or removal of websites and accounts

We may suspend, restrict, remove, or close any website or account at any time. This may happen with or without prior notice and without giving an explanation, especially if we believe it is needed to protect the service, our business, other users, third parties, or legal compliance.

12. Service availability

We aim to provide 99% uptime for the service. However, we do not guarantee that the service will always be uninterrupted, error-free, secure, or available at all times. The service may be unavailable from time to time because of maintenance, updates, technical issues, third-party services, hosting issues, payment provider issues, or other reasons.

13. No guarantee of results

Simple Business Website helps businesses create websites, but we do not guarantee any specific business results. We do not guarantee website traffic, SEO rankings, sales, leads, customers, revenue, or business growth. You are responsible for your own business decisions and results.

14. Website content export

If you want to receive your website content, you can contact us at [email protected]. We will try to help where reasonably possible, but we do not promise that every type of content, layout, setting, or technical configuration can be exported.

15. Account and website deletion

If you want to delete your account or website, please contact us at [email protected].

16. Emails from us

We may contact you by email about your account, billing, payments, service updates, security matters, legal updates, or other important information related to the service. You are responsible for keeping your email address up to date.

17. Privacy

We handle personal data according to our separate Privacy Policy.

18. Liability

To the maximum extent permitted by law, TopSoft UG is not liable for indirect damages, lost profits, lost revenue, lost data, business interruption, loss of customers, or other financial or business losses related to the use or inability to use the service. Nothing in these Terms limits liability where liability cannot legally be limited under applicable law.

19. Changes to these Terms

We may update these Terms from time to time. If we make important changes, we may inform customers by email or through the service. Continued use of the service after changes means that you accept the updated Terms.

20. Governing law and jurisdiction

These Terms are governed by the laws of Germany. The place of jurisdiction, where legally permitted, is Berlin, Germany.
